The drug’s maker, Pfizer, is facing allegations that it illegally marketed and sold fake versions of Viagra in a bid to boost sales.
Pfizer’s patent on Viagra’s active ingredient, sildenafil citrate, expires in April 2020, and Pfizer’s patent expires in March 2017, according to federal court records. Sildenafil, which is sold under the brand names Viagra and Levitra, is also known as Vardenafil.
In 2010, the FDA approved the drug for the treatment of erectile dysfunction, but only when the benefits outweigh the risks. In 2013, the agency issued an alert for counterfeit drugs.
Pfizer’s Viagra, containing the same active ingredient as the drug’s brand-name counterpart, is sold in over-the-counter versions under the brand name Bayer’s generic form.
The two drugs were first developed and patented by Pfizer in 1998. Pfizer filed a lawsuit against Pfizer in 2010, alleging that the drug and its generic versions were misbranded and not effective in treating the condition.
The drugmaker alleged in the lawsuit that it sold the fake versions of Viagra to Pfizer, paying a $2.50 per pill to insurers who approved them. It also paid Pfizer for promoting the fake versions, according to the lawsuit.
Pfizer’s Viagra, which contains the same active ingredient as the drug’s brand-name counterpart, was approved by the FDA in 2013. Bayer’s Levitra is not yet available as a generic drug.
Pfizer said it would not comment on pending litigation.

Pfizer said that it was aware of the alleged violation but that it is not making any comment on the lawsuit. Pfizer said it intends to seek monetary damages in the coming weeks. The company said it will update its website and social media accounts with details about the allegations.
